12 Month Program - Terms of Service
1. Agreement
This Services Agreement (“Agreement”) is made between Applied Recovery Co Pty Ltd (ABN 59 646 251 630) trading as Clean Slate Clinic (“Clean Slate Clinic”) and the individual agreeing to these terms (“Client”). This Agreement sets out the terms under which Clean Slate Clinic will provide its services to the Client.
​By agreeing to this document, the Client confirms acceptance of these Terms of Service, the Privacy Policy accessible here: Clean Slate Clinic Privacy Policy, and any required consents associated with the service. The Client acknowledges that this is a legally binding financial commitment.

2. Payment Options
The Client agrees to pay for the Clean Slate Clinic program through one of the following options:
(a) One payment totalling $3,900 (exclusive of GST); or
(b) Two payments of $950 and $2,950 totalling $3,900 (exclusive of GST); or
(c) 12 monthly payments of $380 totalling $4,560 (exclusive of GST) (“Payment Plan”).
The first payment must be made before the First Nurse Assessment. For Payment Plan Clients, subsequent payments will be automatically charged each month to the nominated payment method. Failure to choose a payment option or to make the first payment before the First Nurse Assessment may result in delays or denial of services until the payment obligations are met.​​

3. Program Description
The Clean Slate Clinic 12-month program consists of three phases:
Phase 1: Assessment & Preparation
​
Two nurse assessments, one medical prescriber (either Doctor or Alcohol and Drug Nurse Practitioner) appointment, care package (for Clients on our alcohol pathway), and withdrawal preparation over approximately two weeks.
Phase 2: Withdrawal
​
Medically supervised home-based withdrawal (detox) with daily clinical reviews and a further medical prescriber consultation, which includes discussion and prescribing of craving-reduction medication (if appropriate).

Phase 3: Recovery & Maintenance
​
Three weekly nursing reviews, three monthly nursing reviews, three quarterly nursing reviews (9 appointments in total) and access to unlimited SMART Recovery meetings and online resources.
​
On completion of Phase 3 (12 months following program commencement) the client will be discharged from the Clean Slate Clinic program. Additional services can be purchased thereafter.

5. Payment Terms
Phase 2 and Phase 3 are clinically integrated and form a single therapeutic program. By proceeding to the first nurse appointment in Phase 2, the Client agrees to undertake the full Program, including Phase 3, and commits to the full program fee, as outlined in Service Agreement.

Clients may choose to pay the program fee in full upfront or via a payment plan. Choosing a payment plan does not convert the Program into a month-to-month or cancellable service. The full program fee remains payable upon commencement of Phase 2, regardless of early withdrawal or discharge, except where agreed in writing. This structure enables us to allocate appropriate clinical resources to support the Client throughout their recovery and ensure continuity of care.

Missed or cancelled appointments (with less than 48 hours' notice ) are forfeited and non-refundable. Additional sessions may be purchased separately, if required.

6. Payment Authorisation
The Client authorises Clean Slate Clinic to deduct payments from their nominated payment method. The Client must ensure the payment method remains valid with sufficient funds. If a payment method expires or is lost, it is the Client's responsibility to provide an updated payment method prior to the next due payment.​

7. Refunds and Cancellation Policy​​
​
The following refunds apply:
​
(a) If the Client cancels more than 48 hours before the First Nurse Assessment, they are eligible for a full refund.
(b) If the Client opts out after the First Nurse Assessment, and notifies Clean Slate Clinic in writing within two business days of the appointment, they will be charged $380.
(c) If the Client opts out after the First Nurse Assessment but during Phase 1, and notifies Clean Slate Clinic in writing within two business days of the appointment, they will be charged $950.

General Refund Terms
Refunds are available only in the circumstances outlined above or in exceptional circumstances as determined by Clean Slate Clinic management.​

If the Client proceeds to Phase 2, all payments under Clause 2 become payable, regardless of subsequential cancellation or if the Client is discharged early from the program.
Refunds will be processed within 14 business days to the original payment method. Administrative fees will not exceed $50, and 'services rendered' will be defined as any appointments conducted, care packages delivered, or assessments completed.

8. Obligations and Warranties
​
The Client agrees to pay the full program cost unless eligible for a refund under Clause 7. The Client acknowledges that this is not a subscription service but a legally binding financial obligation.

Clean Slate Clinic warrants that all personnel delivering services are appropriately qualified, trained, and experienced in accordance with Australian healthcare regulations. Services will be provided with due care and in compliance with Clean Slate Clinic's Privacy Policy and clinical guidelines.
9. Consequences of Non-Payment
​
Failure to meet payment obligations may result in:
​
(a) A late payment fee of $15 for payments over 7 days overdue, capped at a maximum cumulative amount of $90.
(b) Interest on overdue payments at 3% per month.
(c) Suspension of services until overdue payments are resolved.
(d) Transfer to a collection agency for recovery with recovery costs borne by the Client.

10. Amendments
This Agreement may only be amended in writing, signed by both parties.

12. Liability, Governing Law & Jurisdiction
​
(a) This Agreement is governed by the laws of New South Wales (NSW).
(b) Disputes arising under this Agreement are subject to the exclusive jurisdiction of NSW courts.
(c) Clean Slate Clinic provides services on an ‘as is’ and ‘as available’ basis. While all reasonable efforts are made to deliver safe and effective clinical care, Clean Slate Clinic does not guarantee specific health outcomes.
(d) The Client acknowledges that telehealth services may be affected by technical failures outside Clean Slate Clinic’s control, and Clean Slate Clinic is not liable for service disruptions due to internet failures, software malfunctions, or third-party service interruptions.
(e) To the maximum extent permitted by law, Clean Slate Clinic’s liability for any claim, whether in contract, tort, or otherwise, is limited to the total amount paid by the Client for services rendered under this Agreement.
(f) Nothing in this Agreement is intended to limit the Client’s rights under the Australian Consumer Law. If any provision of this Agreement conflicts with a non-excludable right under Australian Consumer Law, the conflicting provision shall be read down to the minimum extent necessary to comply with the law.
(g) Formal notices under this Agreement must be delivered via email to the registered email address provided by the Client. Notices sent via email will be deemed received 24 hours after transmission unless a failure notification is received. The Client agrees to keep their contact details up to date and notify Clean Slate Clinic of any changes.

13. Important Client Acknowledgements and Agreement
​
(a) The Client acknowledges that the program represents a significant financial commitment. Before agreeing, the Client should consider their financial situation and seek independent advice if needed. By agreeing, the Client confirms they understand and agree to these terms.
(b) By agreeing to this Agreement, the Client represents and warrants that they are over 18 years of age, they have the full right, power and authority to agree to and be bound by the terms of this. Agreement, and to fully perform all of their obligations under this Agreement.
(c) By agreeing to this Agreement, the Client also acknowledges and agrees to Clean Slate Clinic’s Privacy Policy, a copy of which is attached to this Agreement as Schedule 1.
(d)The Client acknowledges that services provided under this Agreement are for their personal use only. The Client may not assign, transfer, or sublicense their rights under this Agreement or share Clean Slate Clinic’s program materials with third parties.
(e) If the Client is under guardianship or has an appointed public trustee, the guardian or trustee must sign this Agreement on behalf of the Client. The guardian or trustee acknowledges they have the legal authority to enter into this Agreement, and confirms they are acting in the best interests of the Client. Clean Slate Clinic reserves the right to request documentation verifying the authority of any guardian or trustee prior to providing services

14. Data & Privacy
​
The Client acknowledges that Clean Slate Clinic may collect, store, and use personal information in accordance with its Clean Slate Clinic Privacy Policy. The Client agrees that, in the event of a breach of this Agreement, Clean Slate Clinic may disclose relevant personal and payment information to third-party payment processors for the purpose of enforcing payment obligations, addressing disputes, and recovering outstanding amounts. Such disclosures will be limited to what is strictly necessary to validate transactions, manage chargeback claims, or resolve financial disputes. Clean Slate Clinic will take reasonable steps to ensure any third party receiving the Client’s data complies with applicable privacy laws and maintains appropriate data security standards.
